Steps to submit new Divorce Documents with the Referee Office

!! ATTENTION!!

NEW DIVORCE DOCUMENTS- PLEASE BE SURE YOU HAVE COMPLETED THE FOLLOWING STEPS:

  1. WRITE CLEARLY AND LEGIBLY.  (If we can’t read it, we can’t approve it)
  2. INCLUDE FULL, first, middle, and last NAMES AND ADDRESSES ANYWHERE NAMES AND ADDRESSES ARE REQUIRED ON THE DOCUMENTS.  For no middle name, use (NMN) as an acceptable response.

3. COMPLETE ALL SECTIONS AND LEAVE NO BLANK ANSWERS. EACH SECTION REQUIRES AN ANSWER, EVEN IF THE ANSWER IS NONE. DO NOT USE “N/A”. (Either you have it or not)

4. INCLUDE THE CITY AND STATE WHERE BOTH PARTIES WERE BORN.

5. ALL DOCUMENTS THAT REQUIRE A NOTORY MUST BE SIGNED AND NOTORIZED BEFORE LEAVING THE DOCUMENTS.

6. ONLY SUBMIT FORM SET 1 (DIVORCE COMPLAINT) AND FORM SET 5 (MARITAL DISSOLUTION AGREEMENT) TO THIS OFFICE.

7. PLACE DOCUMENTS IN THE PROVIDED MANILLA ENVELOPE AND WRITE YOUR NAME, PHONE#, AND EMAIL ADDRESS ON THE ENVELOPE.

8. DROP THE ENVELOPE IN THE “LOCKED DROP BOX.

9. YOUR DOCUMENTS WILL BE PLACED IN THE APPROVED OR REJECTED BOX OUTSIDE OF COURTROOM 327 WITHIN 24 HOURS.

10. All Documents left past THIRTY (30) days may be mailed to the plaintiff's listed address on the Divorce Complaint. The MDA is only good for 180 days from the last signature and date on the document.

11. Circuit Court Clerk RM 224 Chancery Court Clerk RM 308. The Divorce Complaint will be stamped with Circuit or Chancery at the top of the document.

12. It is highly recommended that you make copies of your original documents before submitting them. 

13. Before your final hearing, you must check the Circuit and Chancery Court’s website for the division/part to check the particular Court’s preferences and/or procedures on the Court’s website. Please review for uncontested divorce preferences.

YOUR DIVORCE COMPLAINTS WILL BE ADDRESSED WITHIN 24 HOURS, AND THIS OFFICE WILL MAKE A GOOD-FAITH EFFORT TO CONTACT YOU AT THE PHONE# OR EMAIL THAT YOU HAVE PROVIDED. IF YOU HAVE NOT BEEN CONTACTED WITHIN 24 HOURS, YOU MAY COME BACK TO THE LOCATION WHERE YOU LEFT YOUR DOCUMENTS AND PICK THEM UP.
