Division 6 – Uncontested Divorce Requirements
All uncontested divorce cases set in Division 6 before Judge Cedrick Wooten must be reviewed and approved by the Divorce Referee’s Office before the court date. Below is a detailed guide of what must be submitted, when, and how.
Submission Deadlines
To ensure proper review and to avoid delays:
- Complete case packet due: Monday at 12:00 PM (the week of the scheduled hearing)
- If your packet is incomplete or not corrected by these deadlines, your case may be stricken from the docket and will need to be reset for a later date.
Required Documents
All documents must be complete, consistent, and legible.
File-stamped copies are required where applicable. The Final Decree should be fully completed but not filed—leave only the date and judge’s signature blank.
Every case must include:
- Complaint for Divorce (Form 1)
- Marital Dissolution Agreement (Form 5)
- Final Decree of Divorce (complete, correct court caption, includes required insurance and creditor statutes)
- Cost Bill (Shelby County form)
- Health/Insurance Notice (Form 7)
- Military Affidavit (Form 4)
- Confidential Divorce Information Sheet (Shelby County Form)
- Interrogatories or Affidavit in Lieu of Testimony (if applicable)
- Parenting Plan and Parenting Seminar Certificates (if applicable)
- Child Support Worksheet and any Juvenile Court Orders (if applicable)
- Name Change Affidavit (if requesting a name change)
Filing & Submission
- All documents must be emailed in one packet (PDF format preferred) to Deputy Divorce Referee at [email protected]
- Clearly label your email subject line
- Include in the body of the email a brief list of all attachments and indicate how the parties will appear (in person, by Zoom, or by affidavit).
Courtroom Protocol
- Court begins promptly at 9:00 AM. All parties must be checked in with the clerk and Deputy Divorce Referee before that time.
- Room 226 (Divorce Referee’s Office) opens at 8:00 AM for any last-minute questions or review.
- Proper courtroom attire and decorum are required. No hats, tank tops, shorts, or overly casual clothing.
- If appearing by Zoom, participants must be on camera, in a quiet setting, and appropriately dressed.
